Patents

What is a patent?

A patent is a legal right granted by a government to an inventor or applicant preventing others from marketing or commercializing the invention for a limited amount of time.

What are the requirements?

Three criteria must be fulfilled. The first is that an invention must have a technical nature to be patentable. This means that it should be clear which technical problem the invention will solve. The second requirement is that the invention is new. It is thus important not to disclose the invention to others e.g. by publication before the application has been filed. The third requirement is that the invention is non-obvious over already known art at the application date. One generally says that the invention should have an inventive step. The inventive step is the criteria that always give rise to dispute and contention during the phase of obtaining and defending a patent.

Why are patents competition tools?

Databases with patent documents are an indispensable source of information and technology inspiration for every company involved in R&D.

In short, a cluster of patents gives an image of an inventor's ideas. Using this information, competitors and their strategies can be revealed. If, for example, a company files a large number of patent applications in several countries over a short time, it may reveal a new development and marketing strategy for a new product.

The information is of great importance from a competitor's point of view, especially for MedTech and pharmaceutical companies where the development times and costs for a new product are substantial. A careful analysis of the competitor's patents is thus as important as the R&D process.
